Terms of Use (DRAFT)

Last updated: [date]. Operator: [legal entity name], ABN [ABN], [address], Victoria, Australia ("we", "us").

1. What the service is

Quokka is a directory and quoting platform that helps homeowners in Melbourne find licensed tradespeople ("pros") and request quotes. We are not a party to any contract between a homeowner and a pro, do not perform or supervise work, and do not guarantee the quality, price, timing or legality of any work.

2. Accounts

You must be 18+ and give accurate information. Keep your password secure; you are responsible for activity on your account. We may suspend accounts that breach these terms.

3. Pro listings and verification

4. Homeowner obligations

Use quotes for genuine jobs only. Check licences, insurance and written contracts yourself, including obligations under the Domestic Building Contracts Act 1995 (Vic) for work over the relevant threshold.

5. Reviews

Only homeowners who accepted a quote via the platform can review that pro. Reviews must be honest and lawful. We may remove reviews that breach these terms or the law, and we do not edit genuine reviews to change their sentiment. We do not create or buy reviews.

6. Pro subscriptions

There is one pro plan, Standard ($29 per month or $290 per year), and an optional Auto-reply add-on ($9 per month or $90 per year; test pricing, subject to change before launch). Founding pros get their first 3 months free. Auto-reply messages are sent in your name using the rules and words you set; you are responsible for their content. Paid plans are billed monthly or yearly in AUD via our payment provider (Stripe) on our website, renew automatically and can be cancelled anytime via the billing portal, effective at the end of the current period. Prices include GST [confirm]. Nothing in these terms excludes rights you have under the Australian Consumer Law.

7. Prohibited conduct

No false or misleading information, impersonation, harassment, spam, scraping, or attempts to bypass security.

8. Reporting and moderation

Use the Report buttons on profiles and reviews. We review reports and may hide content or suspend accounts.

9. Liability

To the extent permitted by law (including the Australian Consumer Law, which cannot be excluded), our liability is limited to resupplying the service or the cost of doing so. [Lawyer to draft full limitation clause.]

10. Changes, law and contact

We may update these terms with notice in the app. Governed by the laws of Victoria, Australia. Contact: [support email].
